Judges Accused of Jailing Kids for Cash

Luzerne County sits in the heart of northeastern Pennsylvania; Wilkes-Barre is the county seat, a hardscrabble, blue-collar city struggling in this latest recession.

People there were shocked in January when federal prosecutors announced that respected county judges Mark Ciavarella and Michael Conahan had pleaded guilty to tax evasion and honest services fraud, the result of a lengthy investigation by the Internal Revenue Service and the FBI. Yesterday the Pa. State Supreme Court overturned hundreds of convictions of low-level offenders, ruling that all juveniles who had appeared in Ciavarella's courtroom without lawyers between 2003 and 2008 had not been adequately informed when they waived their right to counsel.

It's not over, however, for all of the other kids Ciavarella sent to jail. Chief Justice Ronald Castille said in a statement that Thursday's decision wasn't intended to be "a quick fix."

"It's going to take some time, but the Supreme Court is committed to righting whatever wrong was perpetrated on Luzerne's juveniles and their families," he said. FULL STORY AND VIDEO.

Would this have happened if our schools were doing their duty and teaching Civics. Civics starts with knowing your Rights that are in every State Constitution as well as the Federal Constitution. Isn't it time for parents to start insisting that the public schools start teaching Civics along with American History in Elementary School the way it use to be? The Bill of Rights Institute has wonderful class room lesions on their web sit that any teacher or parent can use for FREE.

Jury Education is another missing element from education. People are serving on juries today not knowing what their real job is. Isn't it time for people to start educating themselves as well as their community? Could Judges Mark Ciavarella and Michael Conahan have so devastated Luzerne County, Pennsylvania if Luzerne County parents had know what their child's Rights were?

I want to draw your attention to a law review article, CREIGHTON LAW REVIEW, Vol. 33, No. 4 1999-2000, 821, IF IT’S NOT A RUNAWAY, IT’S NOT A REAL GRAND JURY by Roger Roots, J.D.

“In addition to its traditional role of screening criminal cases for prosecution, common law grand juries had the power to exclude prosecutors from their presence at any time and to investigate public officials without governmental influence. These fundamental powers allowed grand juries to serve a vital function of oversight upon the government. The function of a grand jury to ferret out government corruption was the primary purpose of the grand jury system in ages past.”

The 5th Amendment:

“No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury.”

An article appearing in American Juror, the newsletter of the American Jury Institute and the Fully Informed Jury Association, citing the famed American jurist, Joseph Story, explained :

“An indictment is a written accusation of an offence preferred to, and presented, upon oath, as true, by a grand jury, at the suit of the government. An indictment is framed by the officers of the government, and laid before the grand jury. Presentments, on the other hand, are the result of a jury’s independent action:

‘A presentment, properly speaking, is an accusation, made by a grand jury of its own mere motion, of an offence upon its own observation and knowledge, or upon evidence before it, and without any bill of indictment laid before it at the suit of the government. Upon a presentment, the proper officer of the court must frame an indictment, before the party accused can be put to answer it.’

“A ‘runaway’ grand jury, loosely defined as a grand jury which resists the accusatory choices of a government prosecutor, has been virtually eliminated by modern criminal procedure. Today’s “runaway” grand jury is in fact the common law grand jury of the past. Prior to the emergence of governmental prosecution as the standard model of American criminal justice, all grand juries were in fact “runaways,” according to the definition of modern times; they operated as completely independent, self-directing bodies of inquisitors, with power to pursue unlawful conduct to its very source, including the government itself.”

Remember this report from our nation’s history?

CNN (Continental News Network) Boston, 1773: The city of Boston canceled a proposed protest over tea taxes today, citing the fear that too many people dressed as Indians would be gathered near the wharves. Organizers expressed sadness over the cancellation, but meekly returned to their homes fearful of upsetting the officers of the Crown. Taxmen breathed a sigh of relief as the tar and feathers were put away not to be used this day.

You don’t remember that pre-revolutionary history? I should say you shouldn’t, because it didn’t happen. But flash forward a few hundred years and you’ll find it is happening today in Cape Coral, Florida where city officials canceled a tax day tea party gathering because they “feel too many people could show-up.”

That’s right, folks, the God-given, long-held American right to assemble and protest the actions of our government has been canceled due to too much popularity of the protest. FULL STORY.

London Protesters Threaten Bankers, Evoke Executions

March 27 (Bloomberg) -- Mark Barrett, a professional tour guide, spent last Saturday painting Barack Obama’s election catchphrase “yes we can” on a banner that protesters will carry as they try to occupy London’s financial district April 1.

Class War, an anarchist newspaper, has produced a special edition to promote the protest with an image of former Royal Bank of Scotland Group Plc CEO Fred Goodwin, whose house was vandalized this week, on a guillotine under the headline “Ready to Riot.” Another shows people dancing around a fire with the slogan “How to keep warm in the credit crunch -- Burn a Banker!” Public anger erupted at Goodwin’s 703,000 pounds annual pension after RBS was bailed out by the government.

The English Revolution culminated with the beheading of Charles I in 1649, ending the so-called divine right of kings in England. Today’s protesters say they draw inspiration from 17th century radicalism.

Four marches will converge on the Bank of England at midday on April 1 for a protest the organizers call “Financial Fools Day.” At the same time, there are plans for a blockade of the European Climate Exchange, in Bishopsgate, to protest against the market in carbon emissions.

“What we’re seeing is unprecedented planning amongst protest groups,” he told reporters on March 21. “There are some clever, innovative people with lots of ideas.” FULL STORY.

Our Colonial ancestors petitioned and pleaded with King George III to get his boot off their necks. He ignored their pleas, and in 1776, they rightfully declared unilateral independence and went to war.

Today it’s the same story except Congress is the one usurping the rights of the people and the states, making King George’s actions look mild in comparison. Our constitutional ignorance—perha ps contempt, coupled with the fact that we’ve become a nation of wimps, sissies and supplicants—has made us easy prey for Washington’s tyrannical forces. But that might be changing a bit. There are rumblings of a long overdue re-emergence of Americans’ characteristic spirit of rebellion.

Eight state legislatures have introduced resolutions declaring state sovereignty under the Ninth and 10th amendments to the U.S. Constitution; they include Arizona, Hawaii, Montana, Michigan, Missouri, New Hampshire, Oklahoma and Washington. There’s speculation that they will be joined by Alaska, Alabama, Arkansas, California, Colorado, Georgia, Idaho, Indiana, Kansas, Nevada, Maine and Pennsylvania.

Well, take a deep breath everyone. The report has been killed, an apology has been issued, and now... there's some BLOWBACK.

The head of the Missouri Department of Public Safety has apologized to U.S. Rep. Ron Paul and two other former presidential candidates for a state law enforcement report linking militia groups to the candidates. State officials killed the report late Wednesday.

State Highway Patrol Superintendent James Keathley said, "Law enforcement officers require intelligence of the highest quality and the report in question does not meet that standard. For that reason, I have ordered (the agency) to permanently cease distribution of the report." FULL STORY

The crash has laid bare many unpleasant truths about the United States. One of the most alarming, says a former chief economist of the International Monetary Fund, is that the finance industry has effectively captured our government—a state of affairs that more typically describes emerging markets, and is at the center of many emerging-market crises. If the IMF’s staff could speak freely about the U.S., it would tell us what it tells all countries in this situation: recovery will fail unless we break the financial oligarchy that is blocking essential reform. And if we are to prevent a true depression, we’re running out of time.

Typically, these countries are in a desperate economic situation for one simple reason—the powerful elites within them overreached in good times and took too many risks. Emerging-market governments and their private-sector allies commonly form a tight-knit—and, most of the time, genteel—oligarchy, running the country rather like a profit-seeking company in which they are the controlling shareholders. When a country like Indonesia or South Korea or Russia grows, so do the ambitions of its captains of industry. As masters of their mini-universe, these people make some investments that clearly benefit the broader economy, but they also start making bigger and riskier bets. They reckon—correctly, in most cases—that their political connections will allow them to push onto the government any substantial problems that arise. But inevitably, emerging-market oligarchs get carried away; they waste money and build massive business empires on a mountain of debt. Local banks, sometimes pressured by the government, become too willing to extend credit to the elite and to those who depend on them. Overborrowing always ends badly, whether for an individual, a company, or a country. Sooner or later, credit conditions become tighter and no one will lend you money on anything close to affordable terms.

The downward spiral that follows is remarkably steep. Enormous companies teeter on the brink of default, and the local banks that have lent to them collapse. Yesterday’s “public-private partnerships” are relabeled “crony capitalism.” With credit unavailable, economic paralysis ensues, and conditions just get worse and worse. The government is forced to draw down its foreign-currency reserves to pay for imports, service debt, and cover private losses. But these reserves will eventually run out. If the country cannot right itself before that happens, it will default on its sovereign debt and become an economic pariah. The government, in its race to stop the bleeding, will typically need to wipe out some of the national champions—now hemorrhaging cash—and usually restructure a banking system that’s gone badly out of balance. It will, in other words, need to squeeze at least some of its oligarchs.

Squeezing the oligarchs, though, is seldom the strategy of choice among emerging-market governments. Quite the contrary: at the outset of the crisis, the oligarchs are usually among the first to get extra help from the government, such as preferential access to foreign currency, or maybe a nice tax break, or—here’s a classic Kremlin bailout technique—the assumption of private debt obligations by the government. Under duress, generosity toward old friends takes many innovative forms. Meanwhile, needing to squeeze someone, most emerging-market governments look first to ordinary working folk—at least until the riots grow too large.

The Dick Act of 1902

The Dick Act of 1902 also known as the Efficiency of Militia Bill H.R. 11654, of June 28, 1902 invalidates all so-called gun-control laws. It also divides the militia into three distinct and separate entities.

The three classes H.R. 11654 provides for are the organized militia, henceforth known as the National Guard of the State, Territory and District of Columbia, the unorganized militia and the regular army. The militia encompasses every able-bodied male between the ages of 18 and 45. All members of the unorganized militia have the absolute personal right and 2nd Amendment right to keep and bear arms of any type, and as many as they can afford to buy.

The Dick Act of 1902 cannot be repealed; to do so would violate bills of attainder and ex post facto laws which would be yet another gross violation of the U.S. Constitution and the Bill of Rights. The President of the United States has zero authority without violating the Constitution to call the National Guard to serve outside of their State borders. U.S. District Court Judge Charged in Superseding Indictment with Aggravated Sexual Abuse and Abusive Sexual Contact

WASHINGTON - A federal grand jury in Houston returned a superseding indictment today charging U.S. District Judge Samuel B. Kent, 59, with aggravated sexual abuse, abusive sexual contact and obstruction of justice, Acting Assistant Attorney General Matthew Friedrich of the Criminal Division announced. Kent was previously indicted on Aug. 28, 2008, on one count of attempted aggravated sexual abuse and two counts of abusive sexual contact of a clerk’s office employee.

The superseding indictment charges three counts based on alleged offenses involving an additional victim who is also a court employee. The first two additional counts charge Kent with aggravated sexual abuse and abusive sexual contact. The third count of the superseding indictment charges obstruction of justice related to an inquiry by a special investigative committee of the U.S. Court of Appeals for the Fifth Circuit into a complaint of judicial misconduct filed against Kent by the clerk's office employee.

The case is being prosecuted by Senior Deputy Chief for Litigation Peter J. Ainsworth and Trial Attorneys John P. Pearson and AnnaLou T. Tirol of the Criminal Division’s Public Integrity Section, which is headed by Section Chief William M. Welch II. This case is being investigated by the FBI.

U.S. District Court Judge Pleads Guilty to Obstruction of Justice


Former New York State Supreme Court Justice Indicted for Attempted Extortion and Bribery

WASHINGTON – A former Supreme Court Justice of the Third Judicial Circuit of the State of New York was charged today with attempted extortion and federal program bribery, Acting Assistant Attorney General Matthew Friedrich of the Criminal Division announced. Thomas J. Spargo, 65 was charged in an indictment returned today by a federal grand jury in the Northern District of New York.

According to the indictment, while Spargo was a state Supreme Court Justice in 2003, he allegedly solicited $10,000 from an Ulster County, N.Y., attorney who had cases pending before the judge. The indictment further charges that Spargo solicited the money by causing the attorney to fear that Spargo would use his official acts and influence to harm the attorney if he was not paid and, conversely, to help the attorney if he was paid.

The case is being prosecuted by Senior Trial Attorney Richard C. Pilger and Trial Attorney M. Kendall Day of the Criminal Division’s Public Integrity Section, headed by William M. Welch II, Chief. The case was investigated by the FBI – Albany Division.

Mom: shot GVSU son 'never had chance'

A sheriff's deputy shot Derek Copp , 20, Wednesday night when authorities entered his off-campus apartment to perform a drug raid. The Ottawa County Sheriff's Department said Copp was unarmed, and has not commented on why the deputy shot Copp.

GRAND RAPIDS, Mich. (WOOD) - A Grand Valley State University student shot by an Ottawa County deputy told his parents he lifted his right arm to cover his eyes from a bright flashlight when the shot was fired.

He told them he didn't know it was a police officer shining the light.

"He never even had a chance to even see who was coming at him, with a bright flashlight in his face," Sheryl Copp, the mother of Derek Copp, told 24 Hour News 8. "He had no clue. He heard someone knock on his door, and he had no clue."

They were entering about 9 p.m. Wednesday through the rear sliding door when the deputy, whose name was not released, fired one shot, police said. That deputy is on paid administrative leave pending the investigation.

Copp's parents said they didn't learn about the shooting until just before 3 a.m. Thursday -- six hours later. They said a nurse and their son called from the hospital. Copp told his parents he gave police their home number and cell phone numbers. They questioned why police did not call them.

A Look at the Jury System and Our Participation in It

The power of a juror:

A single juror has unlimited and unreviewable power that cannot be reversed…. if he is wise. Just one juror can hang the jury and prevent a conviction. And his reasons need not be explained, nor must he even let them be fully known to a single soul. He can just vote to acquit and say nothing else. He can keep his reasons entirely private should he so desire. The juror is a judge of the facts (he didn’t pay his taxes, he had a gun, he protested outside the designated "free speech zone") and he is also a judge of the laws forbidding such actions. Mid-nineteenth-century jurors often refused to convict those who were charged with violating the Fugitive Slave Act. If just a few jurors refused to convict in tax cases the whole phoney mess could be defanged. This power is so great because that way we don’t need 51%, we only need one out of twelve and they are powerless to overcome us.

(An important side note: The juror also has the right to ask questions during the trial but it is best to refrain exercising in our times lest he get bounced from the jury by an arbitrary evil "Judge" for "misconduct.") FULL STORY

This Missouri Police Report which has received wide criticism as reported at KansasCity.com describes anyone who supported not only Third Party candidates, but also GOP Primary Candidate, Republican Ron Paul, as possible members of the Modern Militia Movement. So anyone displaying a bumper sticker on their car showing support for Ron Paul, Bob Bar or Chuck Baldwin, is to be approached with extreme caution. Just like the extreme caution shown in the drug raid on a college student who was shot last week because he opened his door at night, and covered his eyes to block the bright lights shining in his eyes. One would not expect to get shot in the process.

Missouri report on militias, terrorists draws criticism

"It seems like they want to stifle political thought," said Roger Webb, president of the University of Missouri campus Libertarians. "There are a lot of third parties out there, and none of them express any violence. In fact, if you join the Libertarian Party, one of the things you sign in your membership application is that you don't support violence as a means to any ends."

Neal, who has a Ron Paul bumper sticker on his car, said the next time he is pulled over by a police officer, he won't know whether it's because he was speeding or because of his political views.

"If a police officer is pulling me over with my family in the car and he sees a bumper sticker on my vehicle that has been specifically identified as one that an extremist would have in their vehicle, the guy is probably going to be pretty apprehensive and not thinking in a rational manner," Neal said. "And this guy's walking up to my vehicle with a gun."

"It's giving the makeup of militia members and their political beliefs," Hotz said of the report. "It's not saying that everybody who supports these candidates is involved in a militia. It's not even saying that all militias are bad." FULL STORY

If this report isn't targeting the American Citizen who dares to support a candidate other than the chosen media and establishment darlings, and isn't saying that belonging to a 2 Amendment support group such as a Militia, than what is the purpose and nature of this report? A report that clearly states that anyone with the beliefs outlined in this report view the police as the enemy!

Obama appointee on leave after FBI raid, arrests

WASHINGTON - An employee of the D.C. Office of the Chief Technology Officer and a private contractor were charged with corruption Thursday after an FBI raid at the former office of one of President Obama's appointees, Vivek Kundra.

Secret State Police Report: Ron Paul, Bob Barr, Chuck Baldwin, Libertarians are Terrorists

Alex Jones has received a secret report distributed by the Missouri Information Analysis Center (MIAC) entitled “The Modern Militia Movement” and dated February 20, 2009. A footer on the document indicates it is “unclassified” but “law enforcement sensitive,” in other words not for public consumption. A copy of the report was sent to Jones by an anonymous Missouri police officer.

The MIAC report specifically describes supporters of presidential candidates Ron Paul, Chuck Baldwin, and Bob Barr as “militia” influenced terrorists and instructs the Missouri police to be on the lookout for supporters displaying bumper stickers and other paraphernalia associated with the Constitutional, Campaign for Liberty, and Libertarian parties.


MIAC is part of the federal “fusion” effort now underway around the country. “As of February 2009, there were 58 fusion centers around the country. The Department has deployed 31 officers as of December 2008 and plans to have 70 professionals deployed by the end of 2009. The Department has provided more than $254 million from FY 2004-2007 to state and local governments to support the centers,” explains the Department of Homeland Security on its website. Missouri is mentioned as a participant in this federal “intelligence” effort.

Last month, the ACLU issued a news release highlighting the activity of a fusion center in Texas as the “latest example of inappropriate police intelligence operations targeting political, religious and social activists for investigation,” in particular “Muslim civil rights organizations and anti-war protest groups.”

The MIAC report does not concentrate on Muslim terrorists, but rather on the so-called “militia movement” and conflates it with supporters of Ron Paul, Chuck Baldwin, Bob Barr, the so-called patriot movement and other political activist organizations opposed to the North American Union and the New World Order. The MIAC document is a classic guilt by association effort designed to demonize legitimate political activity that stands in opposition to the New World Order and its newly enshrined front man, Barack Obama. But today, as the crisis unfolds in a rapid staccato of collapses, and as the severity of the damage is revealed, we can gain a firmer grasp on certain unassailable facts:

Fact #1. As in the early 1930s, the essence of this crisis is a debt collapse.

Fact #2. The debts today are far greater; and their collapse, more impactful. Specifically, in 1929, for every dollar of GDP, the U.S. had $1.70 in debt; today, it has $3.50, or nearly twice as much. In 1929, there were virtually no derivatives; today, among U.S. commercial banks alone, there are $176 trillion. In 1929, the U.S. was a creditor nation with no debts to foreign countries; now it’s the world’s largest debtor nation, owing more than $2 trillion abroad.

Fact #3. Between its peak in 1929 and its ultimate bottom in 1932, the Dow Jones Industrial Average fell 89 percent, the equivalent of a decline to Dow 1500 in today’s market.

Thus, even if this depression is not more severe than the 1930s, a devastating, long-term bear market still lies ahead.

Two judges in Pennsylvania US took over $2.6 million in bribes from a privately owned prison company to put THOUSANDS of kids in jail for extended sentences for NOTHING!

This took place in broad daylight and scores of people in the justice system in Pennsylvania watched, stood by and did nothing.

The judges are now headed to jail, but the owners of the company who paid the bribes apparently have been to date free of charges.

25% of all the people in jail in the entire world are in jail in the US.

That's today.

Meanwhile, FEMA camps sit empty and waiting all over the country.

The day someone figures out a profitable way to fill them, they will be filled.

Ron Paul and DL Hughley on CNN

I always have to check out the Liberty Maven site.

Ron Paul sat down for an interview with DL Hughley on his CNN show. The interview was quite good. Paul ran through a lot of his talking points plus a bit more.

Hughley seemed awstruck that a Republican is publicly saying the things Ron Paul is saying and has said for many many years, saying that he is “too human to be a Republican.”

Hughley then brings up slavery during the Civil War period, and finishes by asking Paul if he’ll run in 2012. Ron finishes with a funny answer to sidestep the question a bit.

Two Checks on Tyranny

The purpose of the Bill of Rights was twofold: first, to ensure that certain fundamental rights were protected from federal infringement and, second, to ensure that the American people were expressly guaranteed certain procedural rights in federal criminal prosecutions. While all of the rights and guarantees enumerated in the Bill of Rights – as well as those that were not enumerated – are critically important to a free society, it is worth noting that two rights – one fundamental and one procedural – are intended to provide the citizenry with a means to resist federal tyranny should such ever befall our land.

These two rights are the right to keep and bear arms and the right to trial by jury. The gun right is found in the Second Amendment and the jury right is contained in the Sixth Amendment.

Tyranny and gun control

There are those who argue that the right to keep and bear arms has to do with hunting and self-defense against robbers and burglars. While guns are an important part of those activities, they are not the primary reason the Second Amendment was enshrined in the Bill of Rights. The main reason for the Second Amendment is one that government officials are usually uncomfortable talking about: the right and the ability of the citizenry to forcibly resist government officials, including those in the FBI, the CIA, the military, and the police, who are carrying out tyrannical orders of their superiors.

Jury nullification

The right of trial by jury, enshrined in the Sixth Amendment, provides the American people with a nonviolent means to resist tyranny. Trial by jury provides the citizenry with the means to acquit people who are prosecuted by U.S. officials for violating tyrannical laws. FULL STORY.

Liberty Overload - Where was the media during the Primaries?

Ron Paul appeared 3 times Tuesday on Television news channels.

First he appeared on Bloomberg TV to discuss Geithner’s testimony and to rail against the bailouts, as usual:

Speaking of Congress Paul says, “I don’t know if they brainwash themselves or not!”, “It’s a fairy tale!”.

Next, Paul appeared on Glenn Beck’s FOX News show. They discussed the potential for “FEMA Camps”, Obama reducing tax deductions on charitable donations, and the bailouts. Paul brings it all back to the government’s thirst for power and reduction of individual liberty.

And finally, truly the best was last as Ron Paul appears on MSNBC and takes on the media for focusing on semantics instead of the real issues and Rush Limbaugh for not being a better conservative. Paul even indirectly challenges Limbaugh to a debate. It is likely that Limbaugh will have something to say about this on his radio show tomorrow. Then again doing so may give Ron Paul more media than Rush wants him to have, so we’ll see.

The jurors have the power to ignore the court's instructions and bring in a not guilty verdict contrary to the law and the facts. Horning v. District of Columbia, 254 U.S. 135, 138, 41 S.Ct. 53, 54, 65 L.Ed. 185 (1920).


But they should not be told by the court that they have this power. United States v. Krzyske, 836 F.2d 1013, 1021 (6th Cir.), cert. denied, 488 U.S. 832, 109 S.Ct. 89, 102 L.Ed.2d 65 (1988); United States v. Avery, 717 F.2d 1020, 1027 (6th Cir.1983), cert. denied, 466 U.S. 905, 104 S.Ct. 1683, 80 L.Ed.2d 157 (1984); United States v. Burkhart, 501 F.2d 993, 996-997 (6th Cir.1974), cert. denied, 420 U.S. 946, 95 S.Ct. 1326, 43 L.Ed.2d 424 (1975).

They should instead be told that it is their duty to accept and apply the law as given to them by the court. United States v. Avery, supra at 1027.

Did you catch that? The courts know that we, as a self governing people, not only have retained the right to determine the facts involved but we also have retained the right to judge the law as well.

This isn't 1964. While the "traditional media" (whatever that is) MAY lean left, we now have direct mail, talk radio, cable news, and the internet. There is a liberal media, but there is also a significant and influential conservative media to compensate. But the people who need to understand this most seem oblivious to it.

This year’s CPAC was the largest on record. It was encouraging to see the large herds of students moving throughout the hotel. Unfortunately, the constant theme those students heard during this year’s CPAC was that the proper role of the conservative movement is as cheerleader for the GOP.

I must strongly dissent. Ever since George H.W. Bush violated his no new taxes pledge and announced the appointment of David Souter to the Supreme Court, the conservative movement has been the victim of nearly two decades of serial gang rape by the Republican Party and its leadership (George H.W. Bush, Trent Lott, Bob Dole, John McCain, Newt Gingrich, Denny Hastert, George W. Bush, et al.).

Tying our fortunes to the Republican Party is the worst mistake that conservatives have made during the past half-century. Our salvation does not reside with the GOP, but by distancing ourselves from it.

I can relate to all of this, which is why that I was not bashful about hammering McCain during the last presidential race, and ultimately refused to vote for him (I voted third party). FULL STORY.
